9 Questions Following the Supreme Court ruling on Trump
SCOTUS to Colorado: “Are you kidding me?"
All 9 Judges have rejected the decision that Trump should be kicked off the ballot - anywhere. The decision by the Supreme Court to allow Trump’s name on the Colorado ballot means the GOP presidential frontrunner Donald J. Trump will appear on the ballot nationwide, in all 50 states.
Why? Because he was not charged with insurrection, and neither was anyone else and since Trump himself was not charged and “insurrection” as such is largely a misnomer. A President does have immunity to question an election as well as lead a protest, which is what he did. It’s all covered in the Constitution. And US States on their own were never meant to kick candidates off the ballots, Congress has that power as we’ve learned today. It was a bridge too far and always has been. The Supreme Court’s decision today wasn’t even much of a decision as it was a “where the fug do you get off telling voters of your state who they can and can’t vote for?”
Does this mean that the hundreds entered the Capitol illegally on J6 should get off? No, of course not. Those who broke laws saw more than their share of prison time. 80-90% was misdemeanors the Fed tried to raise to felonies.
Does Presidential immunity mean Joe Biden can now do anything he wants to his opponent, as some have suggested? Please. Stop. You know it doesn’t mean that.
Does this mean that Trump can be a dictator if he gets re-elected? Well, would the most liberal judges on the bench vote the way they did if that was a possibility? Come on, the vote was 9-0. No one forced all Judges to vote the same way, they simply followed the Constitution without bias.
Does that mean that Trump has the Supreme Court in his “back pocket,” as some have suggested? He’d still be President if that were the case. His queries to the court on the validity of the 2020 election were rejected, all of them, if memory serves.
Does this mean that Trump can still call the 2020 election rigged despite controversial evidence to the contrary? Yes, it does, - first amendment - as the rest of us enjoy. Trump can say anything he wants about the 2020 election just as thousands of others continue to have opinions about Russia stealing the 2016 election.
Will this ruling stop MSNBC and the NYT from calling Trump an “insurrectionist” and a “coup plotter”? Never, the media enjoys the freedom to bullshit all day long. In fact, bullshit is their business model.
Does this ruling also protect Joe Biden from being arrested the moment he steps down for any number of decisions including those made on the border that some have determined to be illegal? Yes, it does. And that’s why the ruling was 9-0. It protects our constitution and our democracy therein. Like you need me to tell you, right?
Does this mean Jack Smith can precede with his J6 trial against Trump? Of course, he can. But with this ruling, his chances are none and none, as they always have been and would now only serve as publicity for Joe Biden’s brand of democracy which ironically has already been denied by the court’s ruling. Hence, a brand of democracy that does not exist regardless of what some states have said and the media cacophony has echoed.
The anti-Trump propaganda around the election won’t shift an inch because it was never meant to be believed - just repeated. But when the highest court in the land rules unanimously - the press’s bias and its propaganda is exposed, at least for a day or two, before Trump says something else to help them reinforce all of these tropes.
It’s a disservice to the voter, but they don’t care, they can always blame voters when things don’t go their way anyway so … it’s a vicious cycle.
The judges in Colorado HAD TO KNOW this would be the result of their ruling that Trump participated in an insurrection that was not insurrection that will still be called an insurrection for political convenience. But they didn’t care, they didn’t care about the law, the Constitution, or the political fallout.
Well, there’s an election in November, we’ll see how this plays out.
PS. There’s an easy fix for this problem. If you don’t like Trump, don’t vote for him. But don’t prevent others from exercising their right.
